Purchases made through the website www.apartamentomagazine.com are managed by the company Apartamento Publishing, S.L., (hereinafter, “Apartamento”) of Spanish nationality, domiciled at C/ Bruc, No. 49, 3º, 4ª, 08009, Barcelona, with tax identification number ES B65811846, registered in the Mercantile Registry of Barcelona in Volume 43209, Folio 132, Page 427020, with the email address info@apartamentomagazine.com.
The acceptance of these General Terms and Conditions (hereinafter “Terms and Conditions”) implies a binding contractual relationship between you and Apartamento.
These Terms and Conditions make available the conditions that will govern such contractual relationship that establish the use of the website.
1. OBJECT
The website www.apartamentomagazine.com is a Platform where you can buy our own magazines with content about interiors, decorations, art, artists and architect interviews, among others.
Our Platform allows you to subscribe to our magazines. Subscriptions allows you to acquire our magazines once we have launched them. In order to obtain a subscription you only have to pay an annual quota.
In some occasions, you will see some different products that we offer on our Platform, based on our style, such as t-shirts, tote bags, small sculptures, among others.
2. USER OBLIGATIONS
In order to buy the products of the website and be able to establish a contractual relationship, you must be at least 16 years of age and have sufficient legal capacity to sign this contract.
You guarantee that the personal data that you provide to Apartamento are true and accurate, and you agree to notify any change or modification of the same.
You undertake not to use the content that is available on the website in any way that may constitute a violation of any rule of law or in such a way that said use would threaten public order, morals, commonly accepted customs or the name and image of Apartamento and/or its collaborators. Apartamento is not responsible in any case for the misuse of the contents of the website.
You are aware and voluntarily accept that the use of the Service takes place, in all cases, under your sole and exclusive responsibility, for which you shall be liable for the damages of any nature that Apartamento might suffer as a consequence of breach of any of the obligations to which you are subject by these General Conditions.
3. APARTAMENTO’S RESPONSIBILITIES
Apartamento does not guarantee the functioning of the Internet. The service may not be available or may be limited at any time and for any reason beyond Apartamento’s control, whether due to emergencies, connection overload, link failure, network equipment problems, transfers or signal strength. Apartamento is not responsible for data, messages or pages lost or not saved due to performance problems on the Internet service.
In addition to the aforementioned and to the extent permitted by law and, except as otherwise provided in the rest of the General Conditions, in no case Apartamento will be liable for personal, accidental, special, direct or indirect, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damage or loss, related to the use or inability to use the website, regardless of the cause of the theory of liability (contractual or extra-contractual, or any other) and even if you have been warned of the possibility of such damages. Apartamento reserves the right to modify the content of the website without prior notice.
4. PURCHASE
In order to buy any product from our website, you only have to select the product and click the ‘shopping cart box’.
Depending on the products that you have selected of our website, you will find two options:
- Apartamento subscriptions: You will have to fill the Form ‘Check Out’, where you will give us the necessary information to manage your purchase.
- Gift subscription: The User will have to select the subscription and then you will have to fill the Form ‘Check Out’, where you will give us the necessary information to manage your purchase.
- Acquisition of products no related to the magazines: You will have to fill the Form ‘Check Out’, where you will give us the necessary information to manage your purchase.
Regarding each of the items that you can buy through the Platform, you will find a description of it, that means, magazines and subscriptions, issued month, brief description of the content of the magazine, language, and number of magazines that you can obtain with your subscription, among others. For all those products no related to our magazines, such as, clothing, artistic works, notebooks, among others, we will describe them with its material, available sizes, among others.
5. PRODUCT PRICE AND PAYMENT
The price of each of the Apartamento products will be that indicated in Euros. The amount includes all taxes, except shipping costs.
You can pay the cost for the product, either magazines, subscriptions or articles, through the payment forms provided for that purpose, which will allow you to make the payment by using your debit or credit card.
Once you have made the payment, you will receive an email from Apartamento in the email account that you have provided for this purpose, informing that the purchase and payment have been made correctly, as well as the list with each of the items you have purchased through our Platform. If you do not receive an email please let us know at shop@apartamentomagazine.com.

The sale of the products offered on the website is subject to availability. In case of lack of stock of any of the products selected by you, Apartamento reserves the right to cancel the purchase with the corresponding refund of the amount in your favor.
Subscriptions will be renovated automatically every six (6) months, during the periods of November and April of every year. If User wants to cancel the subscription service, it will be able to do it at any moment sending an email to: shop@apartamentomagazine.com.
Subscription payments are nor repayable. Therefore, in the case of cancellation of the subscription, User will continue receiving magazines until the period of the subscription finalised.
Gift Subscription, as it is a product with a determined date, it will be cancelled automatically once the period of the subscription finalised.
6. SHIPPING AND RETURNS
Shipment for all other products is handled through our office in Barcelona, Spain, and shipping costs are charged on top of the retail price. Please note that shipment costs do not include importation costs and/or taxes that may be due when the package reaches its country of destination. You must indicate a postal address where you wish to receive the products purchased on the website. We recommend you to use the postal address where you can ensure that someone can receive the package during working hours, that is, between 9 a.m. and 8 p.m., from Monday to Friday.
You will receive your order at the postal address provided through the website, in the estimated time based on the type of shipment you request at the time of purchase, but never later than thirty (30) calendar days from the acceptance of your order through the website.
The shipping costs will be calculated according to the shipping destination and will appear on the purchase screen before making the payment for your knowledge.
Apartamento is not responsible, under any circumstances, for errors in the delivery of the product that may arise due to incorrect information provided by you. In the event that this involves a delay in delivery, Apartamento will inform you immediately. The costs originated by this circumstance will be at your expense.
If fourteen (14) calendar days have elapsed since the order was confirmed, delivery to the postal address you have given us may not be effective, for reasons attributable to you; we will understand that you have abandoned the order placed.
BOOKS AND MAGAZINES
All our printed products meet all legal guarantees. However, Apartamento is not liable of the misuse or lack of maintenance by Users of our printed products:
- Guarantee excludes any defect clearly identifiable with misuse of the product by the User.
- Guarantee will not apply when the User keep the products I wet places and/or exposed to the sun.
- Guarantee will not apply in those cases when the User finds some color or tonality differences between the image of the magazine on our Platform and the image on the printed magazine.
According to the consumer, regulation magazines do not have the right to return, as long as Apartamento complies with all the guarantees in its magazines.
In this sense, Users only have the right to cancel. That means, if Apartamento has not proceeded with the execution of the User’s order, User may cancel the service as long as the mentioned cancellation is communicate to Apartamento within the period of twenty-four hours (24 hours). After this period, User will not have the right to cancel.
You have fourteen (14) calendar days to exercise your right of withdrawal in relation to the purchase of products no related to magazines on the Platform. For this, the purchased product must be in perfect conditions, with its original packaging and labels and without any damages and/or trace of use. You must also return the invoice enclosed in the package. Otherwise, Apartamento may reject your refund request.
Apartamento will not compensate returned packages that get lost or damaged in the post. All shipping charges that may be incurred when returning products are the full responsibility of the customer. The cost of the merchandise alone will be refunded unless an error has been committed by Apartamento.
You can contact Apartamento to our email address info@apartamentomagazine.com before proceeding with the return of the product.
Once exercised the right of withdrawal and after proceeding to the return of the products, if applicable, Apartamento will refund the full amount of the purchase in a period of time not exceeding fourteen (14) days from the notification of the exercise of your right of withdrawal, that is, since you communicated with Apartamento to inform about the return. The refund will be made to the credit/debit card you used to pay for the order in question. Please note that additional duties, taxes, or any other charges incurred will not be refunded by Apartamento. In the event that you have not communicated to Apartamento your desire to return the item, this term will start at the moment in which Apartamento has received the item.
The property and risks of loss of the products purchased through the website will pass to you at the time of delivery of the order. This risk will remain at your charge in case of return, until the product is delivered to Apartamento.

In the event that the purchased products are defective for any reason attributable to the company, the expenses arising from such return will be borne by Apartamento. Otherwise, the User will assume the shipping costs.
In the case of an exchange, Apartamento will not add additional costs for the shipment of the exchanged product/s.
Please note that magazines and books cannot be refunded or exchanged. However, an exception will be made if the products have been heavily damaged during shipment or arrive in poor condition.
During sale or promotional offers the policy detailed above will apply, with the exception that exchanges will not be accepted.
MERCHANDISE SERIES
You may request to return your order within 14 days of receiving your package. If you would like to switch to a different size, a new order must be placed. All products must be returned in perfect condition to the return address of the Apartamento online store. The products must not have been worn, used, or washed. The Apartamento online store is not responsible for shipping costs involved in returning any item. We will endeavour to refund any returned items as soon as possible, and up to 30 business days after Apartamento receives the items at its return address. Refunds will be made to the same credit/debit card used for the original transaction. Please note that Apartamento is not responsible for any duties, taxes, or additional charges that may have been incurred in shipping the original order.
7. GUARANTEES
Apartamento guarantees that the products comply with the features agreed on the website and that they will without any defect in relation to its manufacture. Likewise, Apartamento guarantees that be delivered said products comply with current regulations regarding their manufacture, composition and packaging, among others.
In the event that the product does not meet the conditions in the previous paragraph, Apartamento will repair or replace it. To do this, you must notify Apartamento your disagreement or malfunction of the product through the form ‘Claims’, enabled for this purpose on the Platform or through the email address shop@apartamentomagazine.com, and always within thirty (30) days since the damage is known. For its part, Apartamento may request information about the product and / or products purchased to verify that the defects are not due to the company, so you must collaborate in this purpose.

Apartamento will respond to your request as soon as possible, and never within a period of more than one (1) month from the date that your complaint or claim is filed.
9. INTELLECTUAL PROPERTY
Content related to the Apartamento’s trademark, website, products, including domains, logos, photographs, drawings or documentation, as well as software, computer programs or any element that could be protected by Intellectual or Industrial Property Rights, that may be accessible for the users, are the property of Apartamento or of the third party who has authorized the used thereof, and all the rights of use thereon are expressly reserved.
You may use such material only in the way expressly authorized by Apartamento or by those who granted us a license for its use.
Any misuse of the service or its obligations by the user may result, at Apartamento’s discretion, in cancellation of user’s account or suspension of the service until the incident is resolved, if applicable.
Likewise, the User undertakes to not withdraw, delete, alter, manipulate or in any other way modify:
- All notes, footnotes, indications or symbols that either Apartamento or the legitimate holder of the rights incorporate into their properties with regard to Intellectual or Industrial Property (such as, for example, copyright, ©, ® and ™, etc).
- Technical devices for protection or identification that may contain the material object of Intellectual or Industrial Property (such as, for example, watermarks, digital fingerprints, etc).
The User recognizes that, by virtue of this General Conditions, Apartamento neither assigns nor transfers to the User any right over its Intellectual and/or Industrial Property, or over any properties of third parties. Apartamento only authorizes the User to access and use them in accordance with the terms indicated in the present General Conditions.
The User is not authorized to copy, distribute (including by email and internet), transmit, communicate, modify, alter, transform, assign or in any other manner display activities that mean the commercial use of Intellectual and/or Industrial Property, be this partially or totally, without the express consent, granted in writing, of the legitimate holder of the rights of use.
Along these lines, Apartamento reserves all rights of Intellectual and/or Industrial Property that correspond to it, including any authorization and/ or license.
Apartamento does not grant any other license or authorization of use to the User on the rights of Intellectual and / or Industrial Property other than that expressly detailed in this clause.
Apartamento reserves the right to resolve or modify at any time and for any reason, the licenses granted under these terms and conditions. Notwithstanding the foregoing, Apartamento may take legal action against any use by the User that:
- Does not comply with the present General Conditions;
- Infringes or violates the Intellectual and Industrial Property rights, image rights or other similar rights belonging to the company or to any other legitimate holder; or infringes any applicable regulation.
10. DATA PROTECTION
For anything related to the processing of your personal data provided to Apartamento, please refer to the Privacy Policy of the website.
11. SEVERABILITY CLAUSE
If any of the clauses of the present General Conditions is deemed to be null and void, and, for any reason, non-applicable, then that clause shall be excluded from the General Conditions, but it shall not affect the validity or application of the remaining clauses.
12. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the Spanish law. Should any discrepancy arise concerning the interpretation and/or execution of this document, the competent Courts shall be those established by the applicable legal regulations regarding the competent jurisdiction of Consumers and Users.

13. MODIFICATION OF THE CONDITIONS OF USE
Apartamento reserves the right to modify the Terms and Conditions established in this document at any time. La aceptación de los presentes Términos y Condiciones Generales (en adelante, los ‘Términos y Condiciones’) supone una relación contractual vinculante entre usted y Apartamento®.

OBJETO
El sitio web www.apartamentomagazine.com es una Plataforma donde usted puede adquirir las revistas de nuestra marca con contenido en interiorismo, decoración, arte, entrevistas de artistas y arquitectos, entre otros.
Asimismo, nuestra Plataforma le permite suscribirse a nuestras revistas, lo que le permitirá recibir las mismas en el momento de su publicación mediante el abono de una cuota anual.
En ocasiones, usted comprobará que en nuestra Plataforma ofrecemos la venta de diferentes artículos, basados en el estilo de Apartamento®, como camisetas, bolsos y pequeñas esculturas, entre otros.
OBLIGACIONES DEL USUARIO
Para poder adquirir los productos del sitio web y poder vincularse contractualmente, usted deberá tener al menos 16 años de edad, así como disponer de capacidad legal suficiente para poder suscribir este contrato.
Usted garantiza que los datos personales que proporciona a Apartamento® son ciertos y exactos, y se compromete a notificar cualquier cambio o modificación de los mismos.

RESPONSABILIDADES DE APARTAMENTO®
Apartamento® no garantiza el nivel de funcionamiento de la red de Internet. El servicio puede no estar disponible o verse limitado en cualquier momento y por cualquier motivo fuera de control de Apartamento®, ya sea por emergencias, sobrecarga de conexiones, fallo del enlace, problemas en equipos de red, transferencias o fuerza de la señal. Apartamento® no se responsabiliza de datos, mensajes o páginas pérdidas o no guardadas por problemas de rendimiento por el servicio de Internet.
En adición a lo indicado anteriormente, y en la medida en que lo permita la Ley y salvo por lo dispuesto en su caso en el resto de las Condiciones Generales, en ningún caso Apartamento® será responsable por daños personales, ni accidentales, especiales, directos o indirectos, incluyendo, sin límite alguno, daños por pérdida de beneficios, pérdida de datos, interrupción del negocio o cualquier otro daño o pérdida comercial, relacionados con el uso o imposibilidad de uso del sitio web, independientemente de la causa, de la teoría de responsabilidad (contractual o extracontractual, o de cualquier otra) e incluso si usted ha sido advertido de la posibilidad de tales daños.

LA COMPRA
Para poder adquirir cualquier producto de nuestra web, Usted simplemente tendrá que seleccionar el producto que desea adquirir y adjuntarlo en el “carro de compra”.
En función de los productos que desee adquirir tendrá las siguientes opciones de compra:
- Suscripción a Apartamento®: En estos casos, la gestión de la compra y envío de la misma, se realizará a través de nuestra propia Plataforma. Deberá cumplimentar el formulario “Check Out”, donde facilitará la información necesaria para la tramitación del envío de su pedido.
- Adquisición de productos que no son revistas o suscripciones: En estos supuestos, la gestión de la compra y envío de estos productos se realiza a través de la Plataforma de Apartamento®. En estos casos, el Usuario deberá cumplimentar el formulario “Check Out”, donde facilitará la información necesaria para la tramitación del envío de su pedido.
Usted podrá modificar los datos de envío o cualquier dato de contacto a través del sitio web siempre y cuando el producto no haya sido enviado y/o procesado para su envío.
Cada uno de los artículos que usted puede adquirir a través de la Plataforma, encontrará una descripción del mismo, esto es, en el caso de las revistas y suscripciones, el mes de publicación, breve descripción del contenido de la revista, idioma en el que se ha publicado la revista y número de ejemplares por suscripción, entre otros. En el caso de productos que no son necesariamente revistas, tales como prendas de vestir, obras de artísticas y libretas, entre otros, los artículos se describirán por materiales, tallas disponibles, en su caso y dimensiones, entre otros.
PRECIO Y PAGO DEL PRODUCTO
El precio por de cada uno de los productos de Apartamento® será el indicado en Euros. La cantidad incluye todos los impuestos, salvo los gastos de envío.
Usted podrá abonar los costes por el producto, ya sean revistas, suscripciones a las revistas o artículos, a través de los formularios de pago dispuestos a tal efecto, que le permitirá realizar el pago mediante el uso de su tarjeta de débito y/ o crédito.
Una vez haya realizado el pago, Usted recibirá un correo electrónico por parte de Apartamento® en la cuenta de correo electrónico asignada a tal efecto, informando que la compra y el pago se han realizado correctamente, así como una descripción de cada uno de los artículos que haya adquirido a través de nuestra Plataforma.
Si Usted no recibe el correo electrónico mencionado en el párrafo anterior, por favor, póngase en contacto con Apartamento® a la siguiente dirección de correo electrónico: shop@apartamentomagazine.com.
La venta de los productos ofrecidos en el sitio web está sujeta a su disponibilidad. En caso de falta de existencias de alguno de los productos seleccionados por usted, Apartamento® se reserva el derecho de cancelación de la compra con la correspondiente devolución del importe a su favor.
ENVÍO Y DEVOLUCIONES
Usted deberá señalar una dirección postal donde desea recibir los productos adquiridos en el sitio web. Le recomendamos que utilice la dirección postal donde pueda asegurar que alguien puede recibir el paquete en horario laboral, esto es, entre las 9.00 horas y las 20.00 horas de lunes a viernes.
Usted recibirá su pedido a la dirección postal indicada a través del sitio web en el tiempo estimado en función del tipo de envío que solicite en el momento de la compra, pero nunca más tarde de treinta (30) días naturales desde la aceptación de su pedido a través del sitio web.
Los gastos de envío se calcularán en función del destino de envío y aparecerán en la pantalla de compra antes de realizar el pago para su conocimiento.
Apartamento® no se responsabiliza, en ningún caso, de los errores en la entrega del producto que puedan surgir por datos incorrectos facilitados por Usted. En el caso en que esto suponga un retraso en la entrega, Apartamento® le informará de manera inmediata. Los costes originados por esta circunstancia correrán a su cargo.
En caso de tener alguna reclamación o consulta respecto al envío, Usted podrá ponerse en contacto con Apartamento® a través de la dirección de correo electrónico shop@apartamentomagazine.com. Apartamento® por su parte, destinará todos sus esfuerzos para atender su petición con la mayor brevedad posible.
Si transcurridos catorce (14) días naturales sin que pueda hacerse efectiva la entrega del pedido en la dirección postal que nos ha facilitado por causa imputable a Usted, se entenderá que Usted desiste del pedido realizado.
- Devoluciones y cancelaciones
Todos los productos impresos por Apartamento® reúnen todas las garantías legales. Sin embargo, Apartamento® no se responsabiliza del mal uso o falta de mantenimiento de los productos por parte del Usuario, esto es:
- La Garantía excluye cualquier defecto que sea claramente identificable con un mal uso o tratamiento del producto por parte del Usuario.
- La Garantía no aplicará en los casos en los que el Usuario lo mantenga en lugares húmedos o con un exceso de exposición al sol.
- La Garantía no aplicará en los supuestos de pequeñas diferencias de color o tonalidades de la imagen de la Plataforma a la imagen impresa.
En base a la normativa de consumo, las revistas carecen del derecho de devolución, siempre y cuando, Apartamento® cumpla con todas las garantías en sus productos.
En este sentido, el Usuario solo dispone del derecho de cancelación. Esto es, siempre y cuando Apartamento® no haya procedido a la ejecución del encargo realizado por el Usuario, este puede cancelar el servicio siempre que dicha cancelación sea comunicada dentro del periodo de tiempo de veinticuatro (24) horas. Transcurrido este periodo, el Usuario no podrá ejercer su derecho a cancelación. El Usuario, recibirá un mensaje en el correo electrónico facilitado a tal efecto, una vez el producto haya sido procesado para su envío, momento en el cual éste perderá su derecho a cancelación.
Usted dispone de catorce (14) días naturales para ejercer su derecho de desistimiento en relación a la compra de productos no relacionados con las revistas. Para ello, el producto adquirido debe encontrarse en perfectas condiciones, devolverlo en su estado original, dentro de su embalaje originario y sin rastro de uso. En caso contrario, Apartamento® podrá rechazar su solicitud de devolución.
Si lo desea, puede ponerse en contacto con Apartamento® a la dirección de correo electrónico shop@apartamentomagazine.com antes de proceder a la devolución del producto.
Una vez ejercitado el derecho de desistimiento y procedido a la devolución de los productos, si procede, Apartamento® le devolverá el importe íntegro de la compra en un periodo de tiempo no superior a catorce (14) días desde la notificación por su parte del ejercicio de su derecho de desistimiento, esto es, desde que Usted se comunicó con Apartamento® para informar sobre la devolución. En el supuesto en el que Usted no haya comunicado a Apartamento® su deseo de devolución del artículo, este plazo comenzará en el momento en el que Apartamento haya recibido el artículo.
La propiedad y riesgos de pérdida de los productos comprados a través del sitio web pasarán a Usted en el momento de la entrega del pedido. Este riesgo permanecerá a su cargo en caso de devolución, hasta que el producto sea entregado a Apartamento®.

Los gastos derivados de la devolución del pedido serán soportados por Apartamento® en el caso de que los productos adquiridos se encuentren defectuosos por cualquier causa imputable a la empresa. En caso contrario, los cargos por la devolución correrán por su cuenta. Se habilitará un formulario expreso disponible en el sitio web a tal fin para que usted pueda gestionar la devolución de cualquier producto para cualquiera de los casos mencionados en este párrafo.
GARANTÍAS
Apartamento® garantiza que los productos ofrecidos a la venta en el sitio web cumplen con las características acordadas en el mismo y que serán entregados sin defecto alguno en relación a su fabricación. Asimismo, garantiza que dichos productos cumplen con la normativa vigente en cuanto a su fabricación, composición y envase, entre otros.
En el eventual caso, en que el producto no satisfaga las condiciones mencionadas en el párrafo anterior, Apartamento® reparará o sustituirá el mismo. Para ello, Usted deberá notificar a Apartamento® la disconformidad o desperfecto del producto a través a través de la dirección de correo electrónico shop@apartamentomagazine.com, y siempre dentro del plazo de treinta (30) días desde que se conoce dicho desperfecto. Por su parte, Apartamento® podrá solicitarle información sobre el producto y/o productos adquiridos para comprobar que los defectos no son a causa de la compañía, teniendo Usted que colaborar en tal propósito.
RECLAMACIONES
Usted podrá ponerse en contacto para la comunicación de cualquier queja o reclamación con el servicio de atención al cliente de Apartamento® a través del formulario “Reclamaciones” que se habilita en el sitio web a tal efecto, o a través del correo electrónico [xx].
Apartamento® responderá a su solicitud con la mayor brevedad posible, y nunca en un plazo superior a un (1) mes desde que se presenta su queja o reclamación.
PROPIEDAD INTELECTUAL
Los contenidos relacionados con la marca Apartamento® el sitio web, sus revistas y productos, incluyendo dominios, logotipos, fotografías, dibujos o documentación, incluyendo, software, programas informáticos, o cualquier elemento que pueda ser susceptible de protección por la legislación de Propiedad Intelectual o Industrial, que puedan ser de acceso a los usuarios, son de propiedad de Apartamento® y quedan expresamente reservados todos los derechos de uso sobre los mismos.
Usted podrá hacer uso de dicho material únicamente en la forma en que Apartamento® se lo autorice expresamente o quienes nos otorgaron licencia para su uso.
Cualquier uso indebido del servicio o de sus obligaciones por parte del usuario podrán derivar, a discreción de Apartamento®, en la cancelación de la cuenta del usuario, o suspensión del servicio hasta que se resuelva la incidencia, en su caso.
Asimismo, el usuario se compromete a no retirar, suprimir, alterar, manipular ni en modo alguno modificar:
- Aquellas notas, leyendas, indicaciones o símbolos que, bien Apartamento® o los legítimos titulares de los derechos, incorporen a sus propiedades en materia de Propiedad Intelectual o Industrial (como por ejemplo, copyright, ©, ® y ™, etc.).
- Los dispositivos técnicos de protección o identificación que pueda contener el material objeto de Propiedad Intelectual o Industrial (como por ejemplo, marcas de agua, huellas digitales, etc.).
El usuario reconoce que, en virtud de las presentes Condiciones Generales de Uso, Apartamento® no cede ni transfiere al usuario ningún derecho de Propiedad Intelectual y/o Industrial, o sobre cualesquiera derechos de terceras partes. Apartamento® sólo autoriza al usuario el acceso y uso de los mismos de conformidad con los términos indicados en los presentes términos y condiciones.
Los usuarios no están autorizados para copiar, distribuir (incluyendo correos electrónicos e Internet), transmitir, comunicar, modificar, alterar, transformar, ceder o, en cualquier otra forma desplegar actividades que conlleven el uso comercial de los derechos de Propiedad Intelectual y/o Industrial, ya sea con carácter parcial o total, sin que conste el expreso consentimiento, otorgado por escrito, del legítimo titular de los derechos de explotación.
El acceso y uso de la Plataforma se realizará siempre y en todo caso con fines estrictamente personales y no comerciales.
Apartamento® se reserva todos los derechos de Propiedad Intelectual y/o Industrial que le correspondan, incluyendo cualquier autorización y/o licencia.
Apartamento® no concede ninguna otra licencia o autorización de uso al Usuario sobre los derechos de Propiedad Intelectual y/o Industrial distinta de la que expresamente se detalla en la presente cláusula.
Apartamento® se reserva el derecho de resolver o modificar en cualquier momento y por cualquier causa, las licencias otorgadas en virtud de los presentes términos y condiciones. Sin perjuicio de ello, Apartamento® podrá emprender acciones legales contra cualquier utilización por parte del usuario que:
- No sea conforme a los Condiciones Generales de Uso aquí especificados;
- Infrinja o vulnere los derechos de Propiedad Intelectual o Industrial, de imagen u otros análogos de la Sociedad o de cualquier otro tercer legítimo titular; o infrinja cualquier normativa que sea de aplicación.
PROTECCIÓN DE DATOS
En todo lo relacionado sobre el tratamiento de sus datos personales facilitados a Apartamento® remítase a la Política de Privacidad del sitio web.
INDEPENDENCIA DE LAS CLÁUSULAS
Si cualquiera de las cláusulas de los presentes Condiciones Generales fuera nula de pleno derecho o anulable, se tendrá por no puesta. Dicha declaración de nulidad no invalidará el resto del documento, que mantendrá su vigencia y eficacia entre las Partes.
LEGISLACIÓN APLICABLE
Los presentes Términos y Condiciones se regirán por la legislación española, que será de aplicación en lo no dispuesto en materia de interpretación, validez y ejecución. En caso de discrepancia en la interpretación y/ o aplicación del presente documento, los Juzgados competentes serán los que disponga la normativa legal aplicable en materia de jurisdicción competente de Consumidores y Usuarios.
Asimismo, el usuario podrá resolver de forma amistosa incidencias que se pudiesen producir durante la relación contractual a través de la Plataforma impulsada por la Comisión Europea https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=ES.
MODIFICACIÓN DE LAS CONDICIONES DE USO
Apartamento® se reserva el derecho a modificar el presente documento de Términos y Condiciones en cualquier momento. En caso de realizar algún cambio en este documento, estos serán publicados en el sitio web y se indicará la fecha de su publicación, para así poder distinguir los Términos y Condiciones más recientes de los Términos y Condiciones anteriores.
